Medicinal, Recreational and Hemp products are legal in Vermont.

Amount of Cannabis Allowed

Adult users are limited to one ounce (1 oz), or 28.35 grams, of marijuana; or five grams (5 g), or 0.18 ounces, of hashish. All registered patients and caregivers are limited to two ounces (2 oz), or 56.7 grams, of usable cannabis; 10 grams, or 0.35 ounces, of hashish.

How much can you grow?

Adults user are allowed to cultivate no more than two (2) mature marijuana plants, or four (4) immature marijuana plants. Registered patients are allowed to cultivate no more than two (2) mature cannabis plants, and seven (7) immature plants.

Fines / Cost

Possession of an open container of marijuana in a vehicle is prohibited. Possession Penalty: Possession of 1 - 2 oz. or 3 mature (and/or 5-7 immature) plants: First offense: Opportunity to participate in the Court Diversion program; otherwise, up to 6 months in jail and/or a fine of up to $500. Second and subsequent offenses: Up to 2 yrs. in prison and/or a fine of up to $2,000. Possession of 2 oz. - 1 lb. of cannabis or 4-5 mature (and/or 8-11 immature) plants: Up to 3 yrs. in prison and/or a fine of up to $10,000. Possession of more than 1 lb. of cannabis or more than 12 mature (and/or 24 immature) plants: Up to 15 yrs. in prison and/or a find of up to $500,000.

Consumption Rules

Cannabis consumption must take place in a private space. Smoking marijuana on or near a school campus, day-care center, or after-school facilities — even after hours — as well as any public place or in public view is prohibited. Consumption of cannabis in a parked car is also prohibited. Being under the influence of cannabis while operating a motor vehicle, boat, or vessel may result in serious criminal penalties.

STATE LAW ON DRUG PARAPHERNALIA



The term "drug paraphernalia" means all equipment, products, devices, and materials of any kind that are used, or promoted for use or designed for use, in planting, propagating, cultivating, growing, harvesting, manufacturing, compounding, converting, producing, processing, preparing, testing, analyzing, packaging, repackaging, storing, containing, concealing, injecting, ingesting, inhaling, or otherwise introducing into the human body a regulated drug in violation of chapter 84 of this title. "Drug paraphernalia" does not include needles and syringes distributed or possessed as part of an organized community-based needle exchange program.



LEGAL POSSESSION RULES



A person 21 years of age or older who possesses one ounce or less of marijuana or five grams or less of hashish and two mature marijuana plants or fewer or four immature marijuana plants or fewer or who possesses paraphernalia for marijuana use shall not be penalized or sanctioned in any manner by the State or any of its political subdivisions or denied any right or privilege under State law. 



ILLEGAL POSSESSION PENALTIES



As of July 1, 2018 adults 21 years and older may legally possess & use marijuana. Decriminalization means there is no prison time or criminal record for first-time possession of a small amount for one’s own use. Possession of small amount is treated like a minor traffic violation.



The law decriminalizes possession of 5 grams or less of hash by anyone age 21 or older. Civil fines are $200 to $500, depending on the number of repeated offenses. Possession of more than 5 grams of hash is a misdemeanor punishable by fines and jail time.



A person who sells drug paraphernalia to a person under 18 years of age shall be imprisoned for not more than two years or fined not more than $2,000.00, or both.
